Please read these terms of service carefully before using Our Service.

1 - Interpretation and Definitions

1.1 - Interpretation

Words with initial capital letters have defined meanings below. These definitions apply regardless of singular or plural usage.

1.2 - Definitions

  • Account: A unique account created for You to access our Service.
  • Affiliate: An entity under common control or ownership.
  • Application: The software program provided by the Operator, named NectarMap.
  • Buyer: Users who place orders for Goods.
  • Country: United Kingdom.
  • Company/Operator (referred to as "we", "us" or "our"): NectarMap, operated by Cai Niclas Wyn, 16 Lon Pobty, Bangor, Gwynedd, LL57 1HR, United Kingdom.
  • Content: Any material (text, images, etc.) posted by users.
  • Device: Any device used to access the Service.
  • Feedback: Comments, suggestions, or innovations sent by You.
  • Goods: Items or services listed for sale or trade on the Service.
  • Order: A request to purchase or trade Goods.
  • Seller: Users listing Goods for sale or trade.
  • Service: The NectarMap website (https://nectarmap.com), app, and all features.
  • Terms: These Terms of Service, which form the full agreement between You and the Operator regarding use of the Service.
  • Third-party Social Media Service: Any external service that interacts with the Service (e.g., Facebook, Google).
  • Website: https://nectarmap.com.
  • You: The individual or entity using the Service.

3 - Acceptance and Eligibility

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least the age of majority in your country (or 18 in the UK) to use the Service.

Use of the Service is also subject to our Privacy Policy.

4 - Governing Law

These Terms are governed by the laws of the United Kingdom. Your use may also be subject to other local, state, national, or international laws.

5 - User Accounts

  • You must provide accurate, current information when creating an Account.
  • You are responsible for safeguarding your password and account.
  • Notify us immediately of any unauthorised use or security breach.
  • We reserve the right to suspend or terminate your account for breaches of these Terms.

6 - User Content

  • You are responsible for any Content you post.
  • By posting Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute it as part of the Service.
  • You must not post illegal, offensive, or infringing Content.
  • We reserve the right to remove any Content at our discretion.

7 - Orders and Marketplace Role

  • NectarMap is a platform connecting Buyers and Sellers. The Operator is not a party to transactions between Buyers and Sellers.
  • All agreements or disputes regarding Goods are between Buyers and Sellers. NectarMap does not guarantee the quality, safety, or legality of Goods, nor the truth or accuracy of users’ Content or listings.
  • Payment is handled via third-party providers (e.g. Stripe, PayPal). You agree to their terms.
  • Any fees payable for use of the Service will be made clear before you place an Order.
  • Sellers are responsible for fulfilling Orders, shipping, and compliance with applicable laws.

8 - Cancellations and Refunds

  • Buyers and Sellers are responsible for handling cancellations, returns, and refunds according to law and their own policies.
  • If you have an issue, contact the other party first. If unresolved, you may contact us for assistance, but we are not responsible for enforcing refunds or returns.

9 - Intellectual Property

The Service and its original content, features, and functionality are the property of the Operator. User Content remains the property of its creators but is licensed to us for the operation of the Service.

10 - Limitation of Liability

To the fullest extent permitted by law, NectarMap and its Operator shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • your use or inability to use the Service;
  • any unauthorised access, use or alteration of your transmissions or content;
  • any conduct or Content of any third party on the Service.

If we are found liable, our liability is limited to the greater of £100 or the amount you paid us in the past 12 months.

11 - Disclaimer

The Service is provided “as is” and “as available”, without warranty of any kind.

We make no guarantee of continuous, error-free, secure or virus-free operation.

12 - Links to Other Websites

The Service may contain links to third-party sites not operated by us. We are not responsible for their content or practices.

13 - Changes to These Terms

We may update these Terms from time to time. Changes will be posted on https://nectarmap.com/terms-of-service. Your continued use of the Service means you accept the revised Terms.

14 - Disputes

If you have a dispute regarding the Service, contact us to resolve it informally first.

15 - Feedback

You assign us a right to use any Feedback you submit for any purpose, free of charge.
